I have been parking my tractor trailer at a local K-Mart parking lot for over a year now. City ordinances recently changed and while I was parked overnight last night my rig was towed. I was willing to accept that under the new ordinance I was illegally parked, but the towing company damaged my trailer, and failed to pull the axles on the truck prior to towing. The rig in question is a 2005 Peterbilt 379 with a Great Dane refer unit attached. Also I called to find out about picking up the truck and was quoted a price of 524 which seemed high, the truck was only towed 2.5 miles, and was towed after 7 pm, but again agreed to accept the charges. I arrived 1/2 hour later to pick up the truck, asked to inspect it prior to paying, found a large scrape and dent on the trailer and told the owner about the damage and confronted him about not using the proper procedure for removing the axles. The bill was then increased to 655, he stated that his "new girl" had quoted me the wrong price on the phone, that I was being charged for 2 days storage, and for 2 pieces of equipment. I filed a police report and took pictures of the damage and intend to pursue the matter further but when is enough enough. I have formerly driven for 2 towing companies, in Ft. Lauderdale and Central Florida. Who can I contact about current towing regulations and also find out if there are any other complaints against this towing company?
Your state is another that uses "towing advisory boards" to oversee the industry. I would call your local city or county clerk to see if they have one.
Your truck should indeed have the driveline removed or the axles pulled before towing, otherwise damage can be done to the un-lubricating transmission. We almost always opt for the driveline.
I can't refute the price they charged because they don't seem out-of-line for two heavy tows and two days of storage.
You don't mention if they admit doing the damage, but if they did do it, they should certainly pay for it. They problem is proving they did it if they don't come out and admit it. There is a chance it was damaged in the parking lot prior to being towed.

Since being an former truck driver sounds like time to kick some ass,but seriously bill is right to what he said,and follow thru what you have planned to do,keep us posted.

Just an update, we filed a complaint with the dept. of agriculture and consumer affairs as there was no apparent governing body for the towing company. We are currently corresponding with them, but it appears that we may be just venting for the sake of feeling better, there is little that can be done to seek any type of justice. For the record we were able to print the florida statutues that govern towing and we were clearly overcharged for storage, however, getting it back may be impossible. Thanks for a forum to at least be heard. You guys were great. You were right about the trailer damage, we have no proof, so there is absolutely nothing we can do about it.
