i have a problem, my sons truck was towed yesterday because 2 tires crossed over the line onto a handicap spot.  we were really irate because the car next to him was over the line and no other parking was avail.  the handicap still had more than enough space to park.

we know that its handicap and the issue there is somewhat valid but they charged $350.00 :ghostface:  for the tow that was no more than 5 miles from home.  the security gaurd knew who the truck belong to and could of at least did a curtosy ticket.  he didn't even tow the car at fault.

this is 2x he's had the truck towed the 1st was $200 and this one seems a bit extreme.

what kind of charges can the tow truck charge and are there any legalities on our part in getting the fee's back?

any help is greatly appreciated,

The tow charge is about right because its the second time,it was towed every time it gets towed from a handy cap spot it goes up until the next time it gets impounded,and court fees in front of magistrate court,i used to tow out of barstow,and the fines went as high as $1000.00 not counting tow charges,please take my advice don't park in a handy cap slot,even if it is the spot left on earth.and if the parking slot next to it is open don't even spit in the spot,it can get very costly.hope this helps. :thumb:

Thats all it takes,when i had to do it in barstow i felt really bad about,not only that the last one i towed was a car without a sticker,and because the tires were over the line,barstow p.d. impounded it,and then come to find out the car belonged to a handicapped person who always parked there.the only thing i might suggest to you is consult a lawyer,also go to your local c.h.p. and find out,who towed it,or should i ask who had it towed.
Did the security gaurd have the right to have it towed?it sounds like he broke protocal by not issueing a courtesy ticket,and its possible he has something going with the tow company,you scratch my back and i'll scratch yours if you get my drift.was this an apartment complex?i would seriously consult the police if they weren't involved,and it sounds like they weren't.just did some checking and the only way it can be towed is if you were parked in the handicap space,according to towing regulations out of california via the net.

If your vehicle was impounded by the Department of Parking and Traffic, and you want to protest the towing of your vehicle, you can request a tow hearing by calling (415) 255-3967 or by going to the Hearing Division, 1380 Howard Street, 1st Floor, Monday - Friday, between 8:00 am and 5:00 pm. Although you have thirty (30) days to do so, you should call or come in immediately. You have the right to a hearing within 48 hours while your car is still at AutoReturn.

If you opt for a mail hearing, you will need to then send a letter stating why you believe the tow fees should be refunded to Tow Hearing Requests, 1380 Howard Street, San Francisco, CA 94103. Submit any evidence you wish to be considered. A decision will be returned by mail. Those choosing an in-person hearing will be contacted to schedule a hearing time.

If you were towed by SFPD and not DPT, you will need to contact SFPD at (415) 553-1619, or go to at 850 Bryant Street, Room 154. Hours to appear for a police department tow are Monday - Friday, 9:00 am - 12:00 noon and 1:00 pm - 3:00 pm. Wednesdays there are additional hours from 4:00 pm - 7:00 pm.

Pretty lame excuse to use part of a disabled space. Sound like the guard showed your son the same courtesy he showed the disabled. :talktohand:
