An out-of-state friend's car was towed when her son drove it with a warrent for not showing at a court date.  She was not aware of all this for about 4 days. After many emails, faxes, and calls to CHP and to the tow company the car was released to me to sell it about 16 days after being towed. The tow co. could  not find the key for 45 minutes, acted angry that I was picking up the car, and swore nothing had been taken from the car when I asked about the cd player and all the cd's and carrier that was used to carry the cd's, plus the tape faceplate-this is after paying the tow and storage cost of $1460. A day later and many calls later they said they had a couple unmarked tape faceplates I could check out only if I was there by Sat. at 4., this was friday evening. It is an hour+plus trip in bad weather and bad traffic to boot. I went and the young girl working that day said the only thing she could find was----the cd player. holder. and cd's and one unmarked faceplate!  This was the same ones they never took or saw supposedly.  When asked about a handwritten in charge of a lien, she said they always charge $70. to file bulk liens on all the cars whether or not picked up.  They have NO paperwork showing this car was on any lien papers, and why should they be allowed to charge for tow and storage-and lien- when they knew we were getting it out? What law is this under and with no proof of them filing?  I really need to know as they have lied repeatedly to me about everything else, including telling us that the car COULD NOT leave before 30 days?

:veryangry: sounds like this outfit doesn't know what the h*** they are doing in california you do not file lien papers until the vehicle has either not been claimed,or abandoned, sounds like another renegade tow company thats wanting to make a very high profit the wrong way and it sounds like they are thiefs, what part of california was this this? $1460.00 sounds like robbery to me.sounds like a company i used to work for, customers would drop off their car and we would go pick them up,and then charge them another tow charge to pick them up. :ko:OUR NICKNAMES FOR THIS COMPANY WAS ENERGIZER BUNNIES,HE ONLY PAID $250.00 A WEEK I LASTED THREE DAYS,AND THEN HE CHARGED ME $90.00 FOR QUITTING WITH OUT NOTICE.. :veryangry:

Hello Midi1952, welcome to ITOW Talk.

It could be that they are required to file the lien. In my state we are required to file vehicles as abandoned after 5 days whether we know the owner is coming for it or not.

It's seems very strange to me that they would remove items from your car. If done for security reasons, they should have one secure place to lockup these item and they should be clearly labeled with the owners name. Removing them the way they did and then not knowing where they were, leads me to believe that they were hoping to keep them.

I'm not very familiar with the rates California towers can charge but I'm having a difficult time getting it to add up to $1460. Even if we assume the tow was $150 and a lein charge $70, that leaves you paying $77.50 per day of storage which can't be right.

Perhaps a California tower could lend some insight here while I'm looking for the laws that apply here, but it doesn't sound proper to me.
