Question: What protects myself and my car from being towed? I was parked at a friends apt complex, and knowing the towing procedures in the area, parked in the visitor’s parking lot, which is 300 feet away from the apartment. My truck was towed because the towing company claims that I was just outside of the visitor parking when I was blatantly not(highly visible signs mark where the visitor parking is). I wouldn’t park so far away just for kicks when the lot was empty. If I was planning on having my truck towed I would have parked closer so I could save up on walking :L: . In any event I was charge 170 dollars before they would release my truck.
My problem is that does the tow truck driver have to show proof that my truck was or was not where it was supposed to be? Digital camera’s are so cheap now, and with the cost of their normal equipment I would think that would be a drop in the bucket (not to mention a way for the towing company to cover their end legally). This entire ordeal that they have put me through is rather aggravating. Not to mention that I am having a hard time finding the necessary legal documentation to possibly take them to small claims court. If any of you can possibly direct me to where I could get proper legal information on this subject I would be most appreciative. This is in Washtenaw County in Michigan. Thanks

I'm sorry to hear about your situation. You're right a digital pic would go a long way and many companies use them today.
I'm not expressly familiar with Michigan law but most states have a hearing process in which you can challenge the validity of the impound and, if found improper, have your money returned. Small claims is also an option, but remember that the burden of proof in on you so collect all the supporting evidence you can.
You can also check with the officials at your county/city building or courthouse and see if you have a "towing advisory board". Many municipalities use a this board to oversee and regulate the towing industry. If not, they will probably have information about a hearing process.
