Okay my car got towed and took for 30 days by the police department.  the lien sale date was 11\17  i got the release from the police department and went to the tow yard on 11\18.  At first they told me that it past lien so the car is theirs now and that i could buy it from them but it going to be sold as is.  The situation is the car has $1700 rims and tires and a $3000 stereo system. So they said i can have it but without the system just the rims.  I got mad and tried dispute the fact and and they told me to F#%^ off that the car is theirs. i tried to reason with them. and they made few calls.  The manager and a few employees made enough comment to make me believe that they already made there claims on my system. The bill to date was $1590   and i had cash in hand. Then the manager came back into sight and told me that the owner of the tow company said that they'd rather keep the car and if i want to bid on it i can come back on one of their auction days.
My beliefs are they already took my system already due to the fact that when i got there they was cool until they found out which car i was there to pick up. then they started acting different, like they was hiding something. Now I'm SOL of my car system and rims.

So if theres any thing i can do to remedy the situation and get my car back?

Another thing is about a few hours later my mom seen the car driving and clearly ID'd the license plate to my car. She couldn't see the driver due to the tinted windows.

Plus this tow yard is known to be shady.  So any and all information would be appreciated    thanks.

By the way I'm new to this forum  My name is Jesse

Hi Jesse, welcome to ITOW Talk.

Are you saying your car was on a 30 day hold, and you were unable to pick it up for 30 days?

yes i couldn't pick it up till after 30 days but the lien sale date was on the 17th and the PD release date was on the 9th  i didnt have the money yet. not till the 18th
Wow, that sucks!

I don't see a remedy for your situation, assuming the impound was valid in the first place.

Once the vehicle goes up for sale, it belongs to someone else.  :(  After the sale date, they have every right to remove and sell the system and rims.

Wish I could help.

Yep, once the car is there long enough to be sold, the towing company already has title to, and owns the car. They are free to dispose of it however they wish, to recover their towing and storage fees.
look up the california code at ca regs
it has a guidance the towing co. is to follow.

So ...the truth be known, they had your car for 30 days as of the 9th, and the sale date was the 17th , and you didn't go there till the 18th?
so you had well over a month to "plan" on how you were going to "pay" for the tow bill, and you didn't....you should have went in before the 17th, cause on the 18th you don't own the car anymore...TOO BAD
If I do the paper work on a vehicle, and if the "owner" doesn't come in AND pay the bill before the "sale date"...they are NOT the "owner" of that vehicle anymore  :poke:  :rasp:  :ko:
