Ok, I am seeking all your combined wisedom.
I'm on leave from the army (we wont go into that), but I was back in michigan visiting some friends, one of whom works for a autoparts store. They were asking for volunteers to work at the Dream cruise (passing out freebies and such) and he asked if I wanted to go...what else was I gonna do? I went. Anyway, he never showed and when I got to the store, they directed me to park on a L-shaped service drive that borders the parking lot and was roped off with caution tape so no one else would park there, it was the employee/volunteer parking area.
I was the last volunteer to leave (at least the last one who parked there) and when I finish loading the last semi at the end of the day my car is gone! I called the cops and said I think my car was stolen...nope! it was towed! a CIVILIAN member of the "Woodward Dream Cruise Parking Enforcement Team" had the city-contracted tow company drag my nice shiney new car to a impound lot! This was at 4:50 (according to the ticket) but the impound closed at 3! I had to walk to the PD, Pay a ticket, then walk another 3 miles to the impound, where I ask this jerk for my car, he says no, not until monday. I reply, WHAT? its saturday, I'm staying at a hotel 55 miles away, I'm on leave which expires sunday night (showed my ID and leave forms). CAN I PLEASE HAVE MY CAR. Nope. not only can I not have my car, but its $250 for the tow ($250 for 2 miles of towing?????) plus $80 a day for storage, starting to day, counting sunday (they are closed! WHAT THE HELL?) and counting monday, even if I pick the car up at 8 am when they open!!! I had to pay a cab back to selfridge ANGB (another 22 miles at $42).
I went BACK to the cops, went WHAT THE HECK? I was on a PRIVATE road OWNED by the autoparts store who TOLD me to park there, they CALLED the PD to tell them to NOT IMPOUND my car, and the PD desk drone says, "The tow company is privately owned, their rates, hours, and policies are none of our concern"
HELP!
I got my leave extended to thursday so I can get my car but this is gonna cost! $240 in storage? $250 for a tow? $40 for "Blocking a private driveway"? What kind of crap is this?
I can only wonder why condition my car will be in... I camped outside the impound waiting for my cab and they were moving cars with FORKLIFTS????
What can I do????
Wow, that's outrageous!
I don't think any state allows a towing company to hold your car after hours. They're sometimes allowed an extra fee for after hours release, but they must release it.
I would begin by asking the organization you volunteered for to reimburse you for the towing mistake they made.
Then, visit your local city hall and see if they have a "towing advisory board" that oversees towing rules and regulations. This board can remedy your situation. If they don't, head down to district court where I know that Michigan offers an impound validity hearing.
I wonder if they didn't also violate Michigan's Impound Sign Code.. It requires that they post very specific signs on that property if they plan to impound.
This Statute says you have 20 days to request your hearing.
Good luck!
I live in Toledo and tow in and out of Michigan. Around here, it's mormally about $90 for a ppi tow and $12 storage. However, when I pick up cars from tow companies in MI, the rates are ridiculous. There are times that a tow from an accident with minor damage and a day or two storage comes to $300 or more. I have a feeling that Michigan in no way regulates what companies charge cause it happens everywhere up there.
