My friend was recently involved in a home invasion. There were 3 vehicles in his property and were taken by PD to their impound. *He was sent to the hospital.* The tow company is charging 1510.00 to take out the vehicles. He did not know where they were until 9 days later. PD does not want anything to do with this. Should we go after the tow company or the PD for not advising that the vehicles were taken to thier yard. Or do I just get an atty and if so what kind of law does he need to practice. Any help is greatly appreciated. PLEASE.
Generally, the responsibility falls on the towing company to notify registered owners of an impounded vehicle.
Assuming the vehicles are in your friends name, and the address on the registration is current, you should have a case against the towing company.
I'm not familiar with all the laws in your area, but they PD may share some responsibility since they directed the vehicles to be impounded.
I would seek to have an impound hearing at the local district court and let the judge decide.
BTW: keep in mind that most notification failures are due to outdated or non-transfered registrations. If that was the case, the notification went to an old address or a different person.
I agreewith bill on this, sounds like you've got a good case!
Why did they impound the vehicles? Did they have something to do with the home invasion? I must be missing something!
$1510 for police impound of 3 vehicles plus 9 day's storage doesn't sound out of line. Impound towing is dangerous, and expensive. Add to that the storage, which in many cities must be done on specially zoned (and expensive) land which is secured with 24 hour surveilance.
I have to also question the "involved with a home invasion". Were the vehicles impounded in connection with this criminal activity, or were they impounded for another reason; say expired registrations?
