can a security co and the tow co they use be connected in any way?
Hi gdmc, welcome to ITOW Talk.

In our state, for the purposes of impounding unauthorized vehicles, absolutely not. In fact, we are also forbidden from impounding from our own property.

What exactly do you think is going on?

well i know of a tow  co that is partially owned   by the security co that gives them all of their tows and the tow co collects citation fees issued by the security co at the time of release whats up with this???
That doesn't sound proper at all. I believe California may have a law against that sort of collusion.

A towing company shall not remove or commence the removal of a vehicle from private property without first obtaining written authorization from the property owner or lessee, or an employee or agent thereof, who shall be present at the time of removal. General authorization to remove or commence removal of a vehicle at the towing company's discretion shall not be delegated to a towing company or its affiliates except in the case of a vehicle unlawfully parked within 15 feet of a fire hydrant or in a fire lane, or in a manner which interferes with any entrance to, or exit from, the private property.

Many states (especially west coast) have outlawed the practice of patrol towing, and in doing so most have also forbidden any sort of collusion between tow companies and security companies (that authorize impounds) because it's simply a loophole to patrol towing.

I also wonder where the authority to collect fines comes from... sounds sketchy. :Oo:

thanks for your replys im pretty sure this kinda skates around the patrol towing because there is an agent of the property [security co.] present at the time of the tow .and as far as i know there is nothing wrong with a security co using a particular tow co exclusivly. but the part about collecting the fees for the sec. co. just dont sound quite right. once again i thank all for your replys
